Trump seeks Supreme Court intervention to halt sentencing in hush money case

8th January 2025 – (New York) U.S. President-elect Donald Trump has requested the Supreme Court to intervene and suspend the sentencing scheduled for Friday in his hush-money case in New York.

On Wednesday, Trump’s legal team approached the nation’s highest court after New York courts declined to delay the sentencing set by Judge Juan M. Merchan, who oversaw Trump’s trial and conviction last May on 34 felony counts related to falsifying business records.

The Supreme Court has called for a response from New York prosecutors by Thursday.

In their motion, Trump’s attorneys requested an immediate stay of the sentencing to avert what they described as “grave injustice and harm to the institution of the Presidency and the operations of the federal government.” Spokesman Steven Cheung echoed this sentiment, urging the dismissal of the case. The Manhattan district attorney’s office has confirmed it will respond through court filings.

Judge Merchan has indicated that he does not intend to impose jail time, fines, or probation in this case.

Trump’s legal representatives have cited a Supreme Court ruling that provides him with broad immunity from criminal prosecution as grounds for overturning his New York conviction. Although that ruling pertained to a separate election interference case, Trump’s lawyers contend that certain evidence used against him in the hush money trial should have been protected under presidential immunity, a position that Judge Merchan has rejected.

The filing submitted on Wednesday is signed by John Sauer, who was appointed by Trump as solicitor general and previously represented him before the Supreme Court in the election interference matter.
