Co-owners fined over HK$90,000 for non-compliance with building removal order

8th January 2025 – (Hong Kong) Two co-owners have been convicted and fined more than $90,000 at the Tuen Mun Magistrates’ Courts for not adhering to a removal order issued under the Buildings Ordinance (Cap. 123).

The case centred on an unauthorised yard structure measuring approximately 20 square metres located beside a house in Yuen Long. As the unauthorised building works (UBWs) were executed without the necessary approval from the Buildings Department (BD), a removal order was issued to the owners under section 24(1) of the Ordinance.

After failing to comply with the order, the BD prosecuted the two owners, resulting in a total fine of $92,280 imposed by the Court. This amount includes a penalty of $82,280 for the duration the offence continued, following their conviction on 27th December, 2024.

A spokesperson for the BD commented today, stating, “UBWs can lead to serious consequences. Owners must act promptly to comply with removal orders. The BD will persist in enforcing compliance against those who neglect such orders, including pursuing prosecutions to uphold building safety.”

Non-compliance with a removal order without a reasonable excuse constitutes a serious offence under the Buildings Ordinance, carrying a maximum penalty of $200,000 and up to one year in prison, in addition to a daily fine of $20,000 for ongoing offences.Share
