China’s Supreme Court strengthens judicial protection for overseas Chinese

8th January 2025 – (Beijing) On Wednesday, China’s Supreme People’s Court (SPC) and the All-China Federation of Returned Overseas Chinese jointly released a significant document aimed at enhancing the judicial protection of the rights and interests of overseas Chinese, returned overseas Chinese, and their families. This initiative marks the first collaborative effort between the two authorities on this matter.

The document calls for higher-level courts, particularly the SPC and regional people’s courts, to enhance their oversight of judicial work and to promptly address challenges in adjudicating cases involving overseas Chinese. It emphasizes the need for courts at all levels to effectively utilise information platforms to improve judicial services related to these cases.

Furthermore, the document highlights the necessity for federations of returned overseas Chinese to recruit more legal professionals and experts from various fields to aid in safeguarding the interests of these groups. It also calls for increased coordination and information sharing between courts and organisations representing returned overseas Chinese during relevant processes.

According to the SPC, since the establishment of an integrated resolution mechanism for social disputes in late 2020, over 270,000 cases related to overseas Chinese have been successfully mediated. In conjunction with the document’s release, the SPC presented five illustrative cases that reflect judicial work in this area, addressing topics such as elderly care services for returned overseas Chinese, the protection of overseas Chinese business interests, child support, property rights confirmation, and dispute resolution involving overseas Chinese groups.
